Took over payments for car but seller didn't pay the bank and kept my money I purchased a car from someone that still owed on it but couldnt afford the payments anymore our arangement was for me to make payments untill the car was paid off then that person would transfer the title to me but the person that I was making payments to didnt actually pay the bank they just kept the money I was giving them and let the car go into reposesion and I have given them almost $2000 so far. Now I have been hiding the car from the repo man for almost a month. Is there anything I can do or do I have any rights? I also have a written contract with the person that states what i have typed here "I make payments they transfer title." |

I think that the only thing you can do in this case would be to let the car go back so that you are not charged with stolen property. Then take the person that you made the agreement with to small claims and sue them for whatever money you gave them. Did they provide you with receipts?

The person did not supply reciepts but I only gave them money orders and personal checks so I have a record of what I have paid them. Someone told me that if I put the car in storage and dont pay the bill that the storage owner can put a lean on the car and if the lean ammount is high enough that the bank would most likely just hand over title to the storage owner and since the storage is actually a friend hiding the car for me that then the storage owner can just gift me the car does this sound lke a possibility or would it even be legal?

That sounds like a scam. I do not think that you should or even could do something like that.
Since you have proof that you paid them, the best option that you have is to give the car to the repo man and then sue in small claims for the money that you paid out.

You already got screwed once are you trying to go to jail ==the car is still the property of the bank and you need to sue the one that sold you the car === without the title you can't get license or insurance ===call the bank explain the situation and volunteer to surrender the car before you get in any deeper

You are screwed. You should never have entered into this arrangement. You are not the registered owner of the car, therefore you have no claim to it. The fact that you made payments to the registered owner and he didn't make them to the bank leaves you out in the cold. I doubt you could win in small claims court either. Even if you did win a judgment against this guy, how could you ever collect the money. He is a scumbag and he totally took advantage of you. Give the car back before you get arrested. You have no proof this is your car. Live and learn. Did you talk to any one else to see if this was a good idea? Don't assume anything and ask for someone with more wisdom than you and you will avoid making crazy money decisions such as this one.

I know you do not want to lose the vehicle, and risk losing the money you've invested in it, but you do not want to end up on the wrong side of the law. Remember, the bank has the right to repossess the vehicle and you have no way of getting the bank to honor your agreement with the third party. It is frustrating to know that you did your part, and the other part took advantage of you, but knowingly hiding a vehicle while it is in repossession is a crime in some states.
Park the vehicle, and research your states repossession laws. Also, consider taking the person to small claims court. They violated the contract by not making payments and you should be able to get back the money you paid, plus additional money to compensate you for any extra money you spent because of their actions.
