Question regarding vehicle repossession and consumer rights I purchased a car through a “buy-here-pay-here” lot in KC, MO. I recently fell behind on my car note. However, I have not received any official notification for the right to cure the vehicle but I know that I am behind. As of yesterday, the President of the dealership stopped by my house at 9:30pm and harassed my children regarding my whereabouts, called this morning at 7:48am in the morning and told my daughter he wanted his car and he needs his car back, then when I turned off my block someone (him) pulled out very quickly and tried to speed up to catch up with me, I turned down another street to get onto the highway. I’m going to pay my car note, but my question is, “is this legal?’. Do I have any rights? |

Most tote the note dealers are honest and would rather have your payments than your car, but when you don't communicate and you miss payments, they have to protect their interests. Go talk to a dealer before missing a payment. Drive to his lot with his car - don't let him worry about either you or the car.

I have a friend who owns one of these dealers and there hope is you miss payments and they repo it.
what they do is install a gps system under the dash, get your down payment, let you miss two payments then repo it and do it all over again. They usually will come get it once the third payment is not received. And it's perfectly legal for them to stop buy everyday to bug you, I think they enjoy the whole process.

Obviously weather your loan is held by a bank or by a buy-here-pay-here type of dealer, you have to sign a purchase and payment agreement. The bottom line is if you don't pay and become in default of the agreement, they have the right to collect the collateral (your vehicle). It your case, if the dealer has taken your vehicle and you want it back, you are going to have to bring your loan out of default. This usually is the payments that you are behind and probably some fees. Make sure you LOOK at the fees. If they are unreasonable, you might consider the advise of an attorney or buying a different car from somewhere else.

The local law enforcement should be notified immediately. Under the privacy act of 1974, your rights have been violated, I would recommend that you get the police report and file a restraining order (No more than a $100 fee) against that individual. If you fail to do so, you will have no solid proof of harassment.

It depends on the state laws and what you have legally signed with the dealer do you still have your documents. Read and go over their policy on late payments and repossession. I know from experience with buy here and pay here I missed three payments and they repossessed my truck.. Good Luck
