Mobile home repossession

2 years ago we voluntarily turned our mobile home in for repossession because we could not afford the payments. the mobile home was sold 5 months later by the mortgage company for substantially less than what was owed.

now they want us to pay the difference which we do not have.

what are our options?

I'm not sure if you have any. You owe the balance on the loan. maybe work out a pymt plan.

Answer 2/11 - Submitted 6/27/2008

You can pay the difference.

you don't have alot of options, since you do owe that much and by letting them repose it, you were giving them the right to sell it for what they can.

it might have been better for you to sell it on your own, as you could have made more for it, and hopefully broken even on it.

The difference and a payment plan are both negotiable, no matter what they may tell you at first. If they turn it in for collection, and they eventually would, thay would then just get a percentage of that difference anyway. Start there, and make sure all your communications are by registered mail so you have verification. Don't do anything for them until you have what they promise in writing.

Is there a time fram in which the lending company can come after you for the owed monies? It has been over 3 years and they are just now surfacing with the bill.

Dwanna you need to ask your own independent question , in a new question. ( and give more details)

Dawanna80... The statute of limitation depends on the state you live in.

Answer 7/11 - Submitted 2/17/2010

The statute of limitatons will apply if IF the debt has not been sold, and the SOL depends on the typoe of debt . as I said , I needed more details and they need to ask in their own question, and not piggy back.

Answer 8/11 - Submitted 2/17/2010

I disagree. If that's the case collection agencies could extend
outstanding debts for decades.

That said. you can get sued at any time. There's no statue of limitation
on lawsuits. If your defense is incorrect or you don't respond you
will have a judgement against you.

Dwanna, we'll be glad to answer your question completely.
As SRDEsq suggested, it's best to start a new thread.
