I was late on car payments and car lot refuses to work out deal they want car back. I was late on my car payment for the first time and the car lot sent a repo man to my job to pick up my car and i dont have car with me its my husbands and he has it out of town. they said they want the truck back or want me to pay car off i told them i could not do that so i tried to make a deal with them and tell them i would give them 3 payments at once and pay 500. for 2 mo and it will pay car off and they said no they want the truck back. what if i dont return car can they press charges for theft? i told them i had an attorney to file BK and they refused to take the attorney number they want nothing to do with me they dont want to take my money or workout a deal they want the car back can i get introuble for not returning the truck i have paid more than half of the truck and they refuse to talk to me. what can i do? |

If it's a TOTE THE NOTE place, you're screwed. this is how these sleaze balls make their money. First, they have a car worth $3500. They sell it to you for $6500, with a hefty down. Say $2500. You then have to make payments TO THEM of $400 a month, or $150 a week, every Friday, or whatever the conditions. You miss one payment, something they knew would happen from the get go, and THEY WANT THE CAR BACK OR FULL PAYMENT. If you could pay for the car in full, you wouldn't have bought it from them.
YOU CAN'T PAY IT IN FULL so they want the car. A lawyer won't help you because the contract states exactly what the deal is. THEY ARE NOT OBLIGATED TO WORK WITH YOU.
If they get the car back, and it's banged up a little, they fix it and charge it back to you, also in the contract. They then sell the same car for the same money and collect a second $2500. Some of these dealers sell the same car as much as 15 times, collect 50% to 75% of the value each time.
GETTING THE CAR BACK makes them more money. Helping you out is not what it's about. Remember, THEY ARE NOT OBLIGATED BY LAW TO WORK WITH YOU IN ANY WAY. CONTRACT LAW has it's own set of law books, and statutes-- all designed to back up the dealer.

I willsee if I can respond without yelling at you. Even if you file BK right away, they can refuse to allow you to reafirm the conmtract. Once you have breached the contract , even by a day, they can repo the car, their contract they had you sign favors them ( it is not the Law, but the contract in which she agreed by signing it ) All you can do at this point is try to re-finance it somehere else, or surrender the car. Do not give them any mor emoney, as you will be pouring it down a rat hole.
Only, if they have acourt order to repo, are you in any danger of "jail" This is not a criminal proceeding, but a civil one. If they cannot steal it from you or you don't surrender the car, will they have to spend money to go to court to get an order. IF they do that , likely the deputies will come with them to serve the orde on you and "stand by" so they can repo the car.
If you violate thecourt order , you can be held for contempt of court, as the court will issue a summons like a abecnh warrant, to have you picked up and brought to court to explain to the court why you disobeyed the court order.
I wish I had better news. Either re-finance it or start looking for a another car. sorry

There is no difference between the buy here pay here financing and other financing ( excluding the high interest ,w hich you would have to pay with any lender if your credit is poor) . ALL loan contracts ( for cars) are the same. While it is true that banks do not want the car back, as they are not in the car selling business) but both CAN repo if you are one day late. Grace periods are rarely contained in todays contracts for autos. And yes, a bank may work with you a bit more ( or not).
people that use "buy here pay here" car dealers are usually forced to due to their income and credit.
People that are desperate rarely read the contracts a sthey are stuck if they need acre to get to work. They count on that mor ethan anything else. to recycle the same car to 5 different, sequential buyers
