Can my car be repossessed when I have the title to my car?

My car was originally financed through Wells Fargo 10/2005. Then in 9/2007 I refinanced my car with my credit union and eventually paid off my car with the credit union in 11/2008. But, in 9/2008 I received a letter from Wells Fargo stating that my payoff was short $2,168.43 and I needed to remit is ASAP or legal action was going to be taken. I contacted my credit union ASAP and they tried contacting Wells Fargo on numerous occasions without response. Wells Fargo did not respond to my phone calls either and I didn't receive anymore letters or phone calls until 2 weeks ago in regard to the same issue and amount. Then, over the weekend they sent a repo man to my house to pick up my car and he stated that Wells Fargo would cancel my title and suspend my license if I did not turn over my vehicle. Of course, I had a few choice words and flashed my title in front of repo man & he left cordially. I have contacted my pre-paid legal plan and have an appointment Thursday, but thought I would ask before hand to see if I could find out what I was possible up against. Thanks.

They are definetly wrong - just take all your correspondence with you to your appointment - they cannot cancel a title or get your license - so don't fret

Your credit union needs to come up with the cancelled check that proves they paid the car off. Submission of the front and back copy of the check should shut them up forever. Wells is the WORST!

Unfortunately places like Wells, will set aside a file and pick it up again later to be reviewed so they can try to collect funds, thus mass amounts of time will pass before being contacted again. The loan contract that you signed with the credit union should have the information obtained by Wells stating the current payoff amount at the time they bought the loan.
Make all requests to Wells in writing.
Request all documentation outlining what is being claimed as unpaid, be sure to ask for specific dates as to when charges occured and what they are for. Also place a request with your credit union for a copy of the payment that was made to Wells. Request the transfer of title on the vehicle that would have been submitted to the credit union by wells upon payment of the loan. The credit union would not have been able to transfer title from them to you, if they never received it from Wells. If Wells released title, they recognized payment in full of the loan. You may need to contact DMV for title information.....although the banks should have maintained a copy for their records.
Present to Wells...once you have it together....the verified payoff amount, the cancelled check, copy of title.
Oh, have you by chance seen your credit report since then? If so, check to see if the Wells account showed paid in full, or outstanding balance owed.

I would review the car title to see if they have a lien on it. I would think the credit union would have paid off Wells Fargo. I would get a copy of the paper work to see if the loan was paid off. I hope this answers your question. Thank you.
