No, he can't have you arrested for car theft. Being in debt for a car is not the same as stealing one off the street.

I tried researching this and here's what I found.
Due to your car you are obligated by a contract and by law you have to surrender your car or faces could be filed against you including criminal ones however I don't see anything about them arresting you if you don't surrender the car however it also depends on the agency as well as the laws in your area. Some places the Repo Man needs to get a court order from a Judge and if he or she accepts it then it'll be sent to the Sheriff's Office. Once that happens, the Repo Man and someone from the Sheriff's Place will come to your place and they'll show you the Judge's Order which at that point in time you have no choice but to surrender the car, if you don't then you'll be charged with contempt of court and can be arrested then.

Repo Man is also breaking a law himself, he cannot discuss your debt with third parties, your business is your business, he has no right to talk about your debt to anyone but you, the original creditor or lawyers representing you and the creditor. That's it. He has no business discussing this with your father. He can also not lie to you about committing a crime.

Report this dimwit to your state attorney general and the FTC for breaking the FDCPA, the Fair Dept Collection Practices Act. You can also sue him for up to $1,000 per violation.

Thank you so much for your input. I thought it was a scare tactic,, but I really needed to be sure. The last thing I want is to be arrested for car theft. I will eventually surrender the car, but I need to try and buy me some time till I get some money together.

You are a looser. If you have to by time to save money to get a new car after driving the car you have not paid on in 3 years, you will never have the money to buy another car. Take it from me, i own a repo company and you are the reason every other consumer who has fallen on hard times is suffering. It is pieces of crap like yourself that make it hard for others who are only 2 months behind and the banks won't work with them, because the finance company also gave you a break and then you in return screwed them over, so they have learned their lesson from loosers like you and now won't give any other consumer on hard times a break. The repo man can not arrest you, but in states like ca there is penal code 504(a) in it states you can not conceal collateral you have on a purchase contract. If your finance company should file this, a bench warrant will be issued for you and you will have to go to court and give up the vehicle or go to jail for contempt. I will say this again, you are a piece of crap and will never amount to anything, but a welfare recipient!

I am in a situation, where I split up with my partner and he has taken the car and its under my name and I had repo guy turn up to my house and I was 3 months behind he was saying but I have been giving my ex partner money to pay the payments as I split my time between working in Melbourne Australia and Los Angeles CA, and I agreed to pay the outstanding and he wants the car back but I don't know where it is, as my ex partner isnt returning my calls and moved out of my house when I was in LA 3 weeks ago, and the repo guy has turned up at my work how embarrassing, and he has accused me of lying which has hurt me.

I have been told by Consumer Affairs they arnt allowed to contact you by phone or in person more than 3 times in a week and this guy has at least 6 times even with me contacting him back and answering his calls and trying to work it out.

It would be easier to see if you can work it out with the finance company and if they dont want a bar of it, try and work as much as you can with the Repo Agent.

I know they are on the defensive but imagine their job isnt pleasant they arnt wanting to turn up to peoples house and take their stuff so try working with them, but dont allow to be harrassed as well ok

I am a single mom, love in PA and lost my job Nov 30th 2010. I have been searching for a job (no I don't get ANY public assistance or child support, believe me I have tried!) and I was notified I am not eligible for anymore unemployment. I got a letter from the credit union that they plan on repossessing the van. How much time usually does it take before they actually come and take it? My kids get no busing to or from school and They are not out for summer until June 1. I am also probably losing my house. I am scared to death! I have never been in this kind of situation and I am afraid I am going to end up in a homeless shelter!
