Automobile reposession utah Repo man knocked on my door on a friday night, I have the money to bring it current but the bank's collection department is closed until monday. The repo man told me he will be back on saturday or sunday with a sherrif to force me to open the garage and hand over my keys, is that legal without a judges order? Can I just leave my car locked up until monday when I pay the bank? |

If your loan is with a bank, take the money on Saturday to the bank. You don't need to go to the collection department. Your loan is with the bank not one particular department. Make sure your get a receipt that is time stamped. When the repo man comes back and happens to bring a deputy buddy of his, give him a copy of the receipt and tell him to leave. If he refuses swear out a trespass complaint. Don't unlock the garage until you have spoken to the bank on Monday
You're absolutely right, without a court order, a sheriff can not force you to open a garage to repo a car. It's a civil matter not criminal.
